Perjanjian Jual Beli Jenitri dengan Sistem Tebasan di Desa Tirtomoyo Kecamatan Poncowarno Kabupaten Kebumen Perspektif Ekonomi Islam

Abstract

A simple sale and purchase agreement will not cause problems, Islam also prohibits transactions that do not enforce Islamic law, such as acting without taking into account the consequences that can result in gharar and cancellation. The aims of the research were: (1) To find out the practice regarding the jenitri sale and purchase agreement with the tebasan system in Tirtomoyo Village, Poncowarno District, Kebumen Regency, (2) To find out the Islamic Economic perspective on the jenitri sale and purchase agreement with the tebasan system in Tirtomoyo Village, Poncowarno District, Kebumen Regency. This research is a qualitative research. The research was conducted in Tirtomoyo Village, Poncowarno Subdistrict, Kebumen Regency, focusing on Dukuh Prupuk with the research subjects was farmers/sellers and jenitri buyers. Data collection techniques were observation, interview, and documentation. Based on the research, the results show that: Buying and selling jenitri by tebasan is an activity that cannot be separated from the community. The jenitri sale and purchase agreement with a tebasan system in Tirtomoyo Village, Poncowarno Subdistrict, Kebumen Regency generally occurs when the jenitri is 1 month to 3 months old before the harvest period with the payment of don’t payment. The Islamic Economic Perspective of the practice of buying and selling agreements with the slash system has not fulfilled the pillars and conditions of buying and selling, namely ma'qud ‘alaih regarding the amount of goods traded. This causes buyers to change the price after the jenitri is harvested and buyers who do not make payments
