Kritik Wacana Tafsir tentang Pembolehan Pernikahan Beda Agama : Respon Penafsiran Ahlul Kitab

Abstrak

Marriage as a legal way to establish a relationship is not as easy as turning the palm of your hand, but also faces several legal problems that must be determined, such as marriages that occur due to different religions. The reason people undergo interfaith marriages is usually motivated by a great sense of love, so that the form of love overcomes the provisions of Islamic law. However, in the legal problems of interfaith marriage, it is still under debate. Several Indonesian scholars say that interfaith marriage is permitted. The purpose of this study is to provide criticism of the opinion that permits interfaith marriage. This research method uses library research. Data mining is carried out by digging up data in the form of interpretations of verses related to interfaith marriage, scientific articles, books and other data related to the research. The results of the study describe that interfaith marriage is not permitted according to Islamic religion and positive Indonesian law, MUI Fatwa Number: 4 / MUNAS VII / MUI / 2005 Concerning INTERFAITH MARRIAGE and the Decision of the Constitutional Court. Therefore, the opinion that allows it because interpreting the verse in the phrase ahlul kitab is those who have the book and believe in the truth of Islam, but hide it and do not apply it in their lives is actually not in accordance with the context of the purpose of marriage and the mission of maintaining religious ideology.
