Abstract

Law is a collection of regulations that regulate the order of a society that must be obeyed by that society. The legal tradition in Europe is about dividing law into two, namely public law and private law, but in the Anglo Saxon or Common Law system there is no such division. A provision that regulates the rights and interests of all individuals in society is called private law. Adoption of a child must be carried out using a legal process, namely through a court order. Adoption of a child through a court institution is to obtain legal certainty, because the legal consequences of adoption concern inheritance and the responsibility of parents towards their child. Submission of an application for a determination to adopt a child can be made at the District Court or Religious Court for people who are Muslim. The research problem concerns the juridical review of applications for the appointment of guardians for children in order to fulfill one of the requirements for entering the Indonesian National Army based on civil law. The purpose of appointing a guardian is to protect the rights and fulfill the child's basic needs as well as manage the child's assets in order to ensure the child's growth and development and the best interests of the child. In Indonesian law, basically those who have the right and responsibility to be guardians, care for and care for children are both parties, namely the husband and wife as long as they have the skills to carry out their duties.
